AEWV Job Check advertising requirements
If you are looking to hire a migrant worker on an Accredited Employer Work Visa (AEWV), you will usually need to advertise the role before you can apply for a Job Check.
The purpose of the advertising is to show that you have genuinely tested the New Zealand labour market and tried to recruit a suitable New Zealand citizen or resident before hiring a migrant.
How long do you need to advertise?
The required advertising period depends on the skill level of the role:
- ANZSCO skill levels 1 to 3: at least 14 days.
- ANZSCO skill levels 4 and 5: at least 21 days. You will also need to engage in good faith with Work and Income about the vacancy.
- National Occupation List roles: at least 14 days.
The advertisement must generally be placed on a national job listing website or platform where New Zealand citizens and residents are likely to apply, such as SEEK or Trade Me Jobs. An appropriate industry specific website can also be used where it is more likely to attract suitably qualified New Zealand applicants.
What does the advertisement need to include?
The advertisement needs to clearly set out:
- the job title and location
- the key tasks, duties and responsibilities
- the minimum and maximum pay or salary
- the type of work and minimum guaranteed hours
- the minimum skills, experience and qualifications required for the role.
It is important to get these details right before advertising. In particular, the skills, experience and qualifications advertised should reflect what is genuinely required for the role.
Employers should also make sure the advertisement aligns with the role they intend to submit as part of the Job Check. Getting the advertising wrong can mean having to advertise the role again before a Job Check can be submitted.
Do all roles need to be advertised?
No. There are some exemptions. For example, advertising is not required where the role meets the Green List requirements or is paid at least $70.00 per hour. There are also specific exemptions for some seasonal visa roles.
Before advertising, it is worth checking the occupation classification and skill level of the role and whether an exemption applies. Getting this right at the beginning can help avoid unnecessary delays with the Job Check.
